The Probate Process: How Does It Work?

One of the questions we often receive is: How does the probate process work? Of course, this is a general account of the process. It can vary depending on the unique circumstances of your situation.

The process starts when an individual dies (the decedent). Someone is appointed administrator if the decedent died without a will or executor if the decedent died with a will in place. Either way, the administrator or executor must file with the probate court to be administrator or executor of the estate.

Probate Hearing

A notice is published declaring an intended hearing. The purpose of the notice is to inform individuals who are beneficiaries or interested parties about the hearing. At the hearing, the judge decides if the appointed person may proceed. If there are no objections, the executor or administrator is officially appointed.

At this point, normally a bond may be required depending on the value of the estate at the authority of the administrator or executor. After about four months, if the creditors are paid off and the judge approves the will or decides on the beneficiaries, the probate matter is completed and the property is distributed to the beneficiaries of the decedent.
