What Is a Guardianship?
There are a number of reasons that parents might be unable to take care of their children, including illness, military commitments, chemical dependency concerns or child neglect. When parents are unable to take care of their children, sometimes a guardian is appointed. These guardianships do not terminate a legal parent's right, and the guardianship may end if the parent is able to care for the child again.
How Is the Guardian Chosen?
Often family members or friends petition the court to be the child's guardian. Additionally, the child can petition the court for a particular guardian. At times, a parent has preselected a guardian for his or her child in a will.
The Basics of Guardianships
There are two different types of guardianships:
- Guardianship of the person: This is a guardianship where the appointed individual must meet the basic needs of the child. Those needs include food, safeguarding the child, protection, shelter, clothing, medical care and education.
- Guardianship of the estate: There is a second type of guardianship that involves the estate. This guardian is appointed when a child receives money or property as inheritance. This individual is charged with handling the child's financial affairs until he or she becomes 18 years old.
